Abstract
Civil protection from harm or oppression by the state officials or its departments is a
policy which is widely reported as violated. There is no denial that law enforcement officers may
in such instances mishandle a perpetrator, or carry out their duties in an unappropriated way in
the line of duty. The decision towards how officers handle arrests reflect the prevailing policy at
the local state. However, it should be noted that the existence of a policy under the statute 42
U.S.C. §1983 does not ensure a significant reduction of such cases, rather provides the core
rights to the civilian to press charges under the clause. Officers who are found guilty of violating
the law are held liable for their undesirable actions, but the plaintiff may choose to sue the entire
department for its failure to train officers to protect civilian rights. The decision to choose whom
to sue is chiefly attributed to the possible facts amounting from each option.
