Contract Performance:
How the Government can encourage a Performing Contractor to Comply with Contract
Requirements for Complex Acquisition.
A contract is spoken or written agreement and specifically pertaining one that has to do
with sales, employment and tenancy all of which are intended to be enforced and backed by the
law of that particular country of its operation. Over the years, contracting as grown gradually to
achieve what can be observed today in the same arena. Contracting can be done between two
individuals, two companies or between the governments and certain companies to aid in
completion and actualization of its projects and undertakings. As such, a contract legally binds
the two involved parties together. Certain characteristics must be fulfilled for a contract to
qualify into operation according to the law. There must be a proposition and a subsequent
acceptance; there must also be an intention between those involved to participate in the binding
relationship in addition to offering consent (Baker, 2012).
Similarly, many companies frequently sign deals and get into contracts with the
government in order to make supplies for the government or to implement a particular task that is
overseen by the government. Government contracts range from simple tasks to complex tasks
that require use of billions of dollars and, as such, the government in conjunction with other
related and interested institutions has to work together in harmony in order to ensure successful
completion of its projects in an efficient and productive manner (Brown, 2003). As a result, the
government is also required to constantly provide encouraging moves to the contractor to aid as a
motivating factor in facilitating provision of high quality product and service to the government.

To achieve a high quality outcome, contractors need to be encouraged constantly through
various means especially when dealing with complex and financial intensive projects. Working
with a contractor requires diligence and effort if the project’s goals and objectives are to be
achieved on time and within the budget set out before its commencement (Brown, 2003). There
are several effective ways to keep the contractor motivated to pursue a complex project and to
achieve excellence in the process some of which are discussed below.
Firstly, it is important to establish and maintain a cordial and good communication with
the contractor. It is pertinent to inquire from the contractor the best means with the firm’s
management prefers to communicate with the facilitators of the government project. Those in
charge of the government’s project are required to frequent the site in order to interact with the
contractor and oversee the operations while creating an ample working relationship and
environment between the government and the contractor. As such, it is preferable for the
contracting party to be onsite everyday and preferably before the work begins. In addition, it is
crucial to plan a meeting with the project leader at least daily. This provides an opportunity for
the government’s project’s managers to inquire and hear the progress reports of the project and
also find out the order and sequence of works that are scheduled for subsequent days. It also
provides an opportunity for the contractor and the government to ask each other questions and
voice any pertinent concerns that may arise (Brown, 2003).
Secondly, financial rewards should be one of the key components of a project as it acts as
a direct motivating factor. Prompt payment is crucial for adequate completion of the project. The
