Facts, issues and court holding

Christopher Simmons, a 17 year old at the time, planned to commit burglary and murder
Shirley Crook. The plot was for him and his friends Benjamin and Tessmer to break in to
Shirley’s house, tie her up and then throw her off a bridge. When the three met on the night of
the murder, Tessmer decided not be part of it. Simmons and Benjamin proceeded as planned and
broke in to the home by reaching through an open window to unlock the back door. They then
tied Shirley’s hands, covered her eyes using duct tape, then threw her body over a bridge which
drowned in the waters (Cornell University Law Shool).
Shirley’s husband reported to the police that his wife was missing. Around the same time
fishermen found her body in the river. Simmons was linked with the murder because he bragged
to his friends that he had killed her. He was at his high school during the arrest and was taken to
a police station in Missouri. After being read his Miranda rights, he waved the right to have an
attorney present and proceeded in answering the questions. During the interrogation, he
confessed to murdering the victim. He also agreed to reenact a video tape at the crime scene.
During the trial, in which Simmons was accused with First degree murder, stealing and
kidnapping, there was overwhelming evidence against him. The evidence included his
confession, videotape reenactment, Tessmer’s testimony and other testimonies of him
premeditating and bragging to his friends about committing the crime. The defense had no
witnesses at the trial stage. Despite his clean record on previous crimes and his young age, the
defendant was found guilty and a death sentence was recommended by the jury.

After the death sentence ruling, Simmons and his new counsel filed a motion to have the
ruling dismissed citing that Simmons was a minor who was likely to act on impulse and could be
easily influence. The Counsel had Simmons neighbors and friends testify of his psychological
problems caused by growing up in a difficult home. However the court rejected the motion.
Simmons decided to appeal.
As the case continued moving up, courts continued upholding that Simmons should be
sentenced by death. However, United States Supreme court finally ruled that imposing a death
penalty to children under the age of eighteen year is unconstitutional. The justice stated that the
