Maria works HealthTech, which is a firm that supplies various types of machinery to hospitals. Her company sent her to a national trade convention for suppliers of health care equipment and technology. She is going to receive one full day of training on Friday. Then, during the next two days, she will attend presentations by several potential firms and experts in the field discussing technical advancements in computer and machining techniques used by her firm to manufacture their products. She has been provided with shirts and laptop computer bags that have her company’s logo, and will be driving a car issued by the firm, and it also has the company logo on the side.
Maria arrived at the convention and attended the Friday events. During the event, she met two of her old friends that graduated from college with her. Her friends work from rival firms, but were also attending the convention. On Friday night, she went out to dinner with them at Outback Steakhouse. Maria drove her company vehicle, and took her friends with her. The parking lot was full, so she parked the car in the parking lot across the street, near the front door of Al’s Discount Liquor.
The group had a nice dinner and discussed a variety of topics, especially current dating arrangements and things that they liked and disliked about their jobs. They also complained about some of their clients, but did not discuss any of the details about their firm’s actual business practices.
Since it was Friday night, they next drove to a local club, and had more drinks. Each person used their personal credit cards for the club expenses They posted several “selfies” on their social media sites. Maria tagged one of the photos with her holding a tequila shot that stated, “Too many shots for a Friday night, but fun hanging out with the team.”
She attended some of the convention meetings during the next two days, but spent most of time the last day at the hotel swimming pool, where she had drinks and used social media on her smart phone.
When Maria returned to work on Monday, her supervisor, Amy, asked how the convention went. Maria told Amy that it was a little boring, but she did learn some interesting things. Amy then said that she needed to meet with Maria.
1. Write a paragraph that evaluates Maria’s actions in terms of antitrust compliance and ethics.
2. The New York Times Headline Test states: How would what I’m doing look in the newspaper? Did Maria “pass” this test? Please explain, and make sure to discuss perceptions. Did Maria’s actions potentially expose herself and/or the firm to accusations of improper business conduct? Explain.
3. What advice would one give to Maria about her conduct when she attends the next meeting?
4. Evaluate the ethics of Maria’s behavior as an employee, and in terms of both using the firm’s resources and representing the firm.
