The problem
Drinking driving is a major threat to road safety in the US it leads to devastating
accidents every year. According to the National Centre for Injury Control: CDC, drinking and
driving costs 28 lives in the US every day, which amounts to one death every 53 minutes (1).
Additionally, drunk driving causes crashes that amount to $44 billion in cost. Drinking and
driving not only possess a threat to the person behind the wheel but also other drivers and the
pedestrians. The Department of Transportation: NHTSA reported that in 2014 there were
9967 drinking and driving deaths, which represents 31% of all motor vehicle traffic deaths in
the US (1). Drinking and driving falls under the category of drinking under the influence
crimes. Drinking and driving is determined using blood alcohol content BAC with many
jurisdictions setting the BAC threshold at 0.05% or 0.08%. This means that driving with a
BAC above the set threshold results to a DUI. Driving under the influences causes
impairment of decision-making capability of the driver, which puts other road users at risk
because the driver may not be able to exercise the required control over the vehicle. World
Health Organization notes that drinking and driving is a major risk factor for road crashes as
well as the severity of injuries that result the accidents arising from drinking and driving.
Further, World Health Organization notes that drivers who drive while impaired by alcohol
are at a higher risk of causing fatal accidents than drivers who are not driving under the

influence. A more grim observation is that most of the population affected by drinking and
driving crashes are children who are in the vehicle with the drunk drivers. While these
fatalities are preventable, perpetrators have continued to be insensitive of how their actions
affect the lives of others. Apart from the fatalities, costs associated with drink impaired
driving crashes can also be hefty. According to a policy impact by CDC, drivers with a
history of DUI are at high risk of DUI (4). According to CDC’s (4) observation, drivers with
records of DUI are more likely to cause a DUI related accident than drivers who are not.
Economic Costs
While loss of life is the major concern for DUI laws, loss of property through
