Capital Punishment
The capital punishment, also known the death penalty, is the practice of punishing a felon for
crimes they have committed by putting them to death. For capital punishment to be implemented,
a judge has to give a death sentence against the defendant when found guilty of the alleged
crimes. Crimes punished by the death penalty are known as capital offenses and may include
murder, espionage, war crimes and treason. In the United States, thirty-one states and the federal
government apply capital punishment (Barry, 2010). The first recorded execution in America
occurred during the colonial period in 1608. The bill of rights that was passed in 1789 included
the Eighth Amendment that prohibited cruel and unusual punishment of crimes. However, the
Fifth Amendment that was passed allowed capital punishment for capital crimes. In 1868 the
Fourteenth Amendment was adopted that required due process of law to be followed before
deprivation of life. The Supreme Court narrowed the scope of capital offenses that are
punishable by the death penalty (Lundin, 2010). It resolved that murder which involves a narrow
