One of the things that one understands while reading through the article is that the tort law is
supposed to protect the victims of negligence. According to the article, there is a possibility that
GM Motors will be liable for a tort claim because of the basis that have been put in place for the
cases to apply. According to the USA Constitution, the tort law applies under the following
conditions:






The defendant of the tort claim is responsible for manufacturing products that are
defective
That the product, at the time of purchase, was defective
That the defect was present when the defendant was making the sale to the victim
There were damages and injuries that were directly resultant from the defect
Lastly, the damages and the injuries that were in the product could have been avoided if
the manufacturer could have forecasted the defect, which is within the scope of their
responsibility.

The article is very categorical when it states that ‘General Motors’ notorious and lamentable
decision to hide from the public a flaw in its ignition switches that could unexpectedly shut off
engine power, with potentially lethal consequences’ to show that the defendant had every
