Description

The deliverable length for this assignment is 4- 6 pages long.

The role of the jury is to apply the law as the judge has instructed. In this case, the defendant was charged with possession of marijuana, based on a search of his car following a traffic stop for speeding. The police did not charge him with the speeding, but only possession of marijuana. The jury was instructed accordingly. During their deliberations, the jurors discussed their anger at the police and prosecutors for using the speeding just to stop the defendant's car and search it and decided that they wanted to send a message to police and prosecutors that they should be focusing on "real" crimes and leave people in possession of marijuana alone, even though it was still illegal in their state. Their belief was that voting "not guilty" would be a message to prosecutors and the police.

Review the materials provided, and discuss the following:

  • Did the jury in this instance act outside of its scope?
  • Is there any remedy for the jury's actions?

biased. This now calls for one to understand what roles the police played in the case and
also the jury.

THE POLICE
The police of our nation and almost at every corner just looking for offenders and so
speeding cars are no exception. So the first question that comes to our mind is, was the
police right in arresting the suspect? This police was within his jurisdiction when he
decided to arrest the suspect. This is because he is protected by the Fourth Amendment of
the Constitution which allows warrantless arrest and suspicion seizure in case it is
required.

The next protocol we check is, did the police in question use the correct measure to
detain the suspect? This he did very well because he detained the suspect until he was
apprehended in court. It is not mentioned anywhere that the suspect was harassed by the
cops or any other authority in question. He prepared the necessary complaint and thus the
suspect was brought to the court for free and fair prosecution. It was now up to the court to
determine whether guilty or not guilty.

And finally we ask ourselves, why did the police not right about the speeding?
According to the United States laws, smoking marijuana or even being found with this
substance is illegal. This alone...
