In American courts the admissibility of evidence in courts is governed by the Federal Rules
of Evidence. These Federal Rules of evidence are the same as federal law. Strictness of rule of
evidence in America is as a result of the numerous limitations and shields towards the citizens
that have been stipulated in the constitution (Golash-Boza, 2012). America’s constitution has
given a lot of attention to the rights and protection of its citizens unlike in other countries. It is
from this point of view that America’s law of evidence gets its strictness from compared to
other countries.
Due process principle advocates that any accused persons should be prosecuted by the law
enforcement agencies by following the set down guidelines. This mostly applies to any citizen
who is accused of a crime. This principle has to be applied equally and fairly. Its application it
is mainly in the Fourteenth Amendment that protecting people from activities by both
governments and the Fifth Amendment protecting people against activities of federal
government. These clauses state that no one should be deprived of it (Golash-Boza
