Hardage v. CBS

In the case between Hardage v. CBS, the legal issue was to determine if Hardage had the
necessary elements for a constructive discharge claim against the accused, CBS for sexual
harassment and retaliation actions which took place following informing his boss. The district
court dismissed the charges and decided that CBS was entitled to assert the affirmative defense.
The appellate court affirmed the decision.
In the case, Hardage alleged that he was constructively discharged since he was working
in a hostile environment. Hardage argued that he was subjected to sexual harassment by Sparks.
In the event of informing his boss about the harassment, he was served with an adverse
performance memorandum. He felt that these two actions made his working environment hostile
to work in and had no option but to tender his resignation. The court disagreed with his
arguments and stated that there was no evidence to prove his arguments as fact (Andrew, 2014).
In my view, Hardage wasn't subjected to a hostile environment since it took him five
