An owner must know the local laws relating to that business, maintain the state’s health department standards for food handling, adhere to the requirements of the state’s alcoholic beverage commission so the liquor license is protected, know the fire regulations for safety, and be able to take care of the staff since they are the front line of the business. Customer satisfaction is of the upmost importance because the hospitality industry relies on word of mouth. Usually bars are close together within distance so being competitive is also important; this can be done by hiring a band and/or offering karaoke night. With the grill section of the establishment there are six different food codes consisting of Food Code 1997, 1999, 2001, 2005, 2009, and 2013. There are six steps in obtaining a food license; determining if it’s a fixed or mobile location, review of plans by the Colorado Department of Public Health and Environment; after plan approval, license application is mailed out along with the plan review approval letter; obtaining a Colorado Sales Tax License from the Department of Revenue (mandatory for ALL retail food establishments); return the application and pay all invoices; lastly, the license will be issued and operation/construction may begin. As far as alcohol laws go in Colorado a bar establishment must have last call by 0200. However, bars, grocery stores and gas stations are only allowed to sell beer but cannot sell it between 0200-0700. The legal age here and everywhere is 21 though in Colorado you can serve alcohol at the age of 18 in a restaurant if a supervisor [over the age of 21] is present. OPEN A BAR 3 Security and Liability in a Bar and Grill A bar and grill may be at risk or violence and fights when alcoholic beverages are served, especially when there is not a drink limit established. With the younger crowd being enticed to drink more, risks go up. At colleges and universities, the younger crowds engage in binge drinking; upbeat music such as pop and hip-hop create an environment of physical activity while strobe lights and such heighten the atmosphere. This is when security personnel come into play. Depending on the crime rate of the city makes a big difference in the methods of security that gets used in a bar and grill. For instance, a club in Chicago, IL may use metal detectors at the door to keep guns and knives outside; whereas, a town such as Penrose, CO this would be an unnecessary measure. It is the right for the owner of an establishment to use reasonable measures to ensure that a safe environment is mostly guaranteed. Colorado holds the commercial vendor owners of bars and taverns responsible for injury caused by drunk patrons. The injured individual must prove the serving of the alcoholic beverages were the reason for “proximate cause” of the injury. A court will look at the then condition of the intoxicated person and whether it was foreseeable to the bar employee as to if that individual was “visibly intoxicated”. Ethical Issues in a Bar and Grill OPEN A BAR 4 It is just not a wise decision to place a bar and grill next to where children attend such as a school, church, park, or daycare center. People do not act like themselves after drinking and operate in behaviors such as cussing, smoking, peeing in public, etc. Restaurants and bars have four sections with their individual ethical issues; Bar/front of the house to include the bartenders and bar-back, the individuals in these areas are responsible for ordering bar inventory, taking orders, and maintaining bar stock; food including servers, busboys, and hostesses, these individuals are responsible for following safety and health regulations along with following service standards; back of the house including cooks and food runners consists of employees who work yet are not seen by the public, and lastly the management, they are the ones who operate the restaurant paying attention to quality. These personnel are responsible for all functions in HR such as taxation documentation, hiring, and payroll.
