In this module, present your research findings on the landmark cases related to competency to stand trial (CST), criminal responsibility, the right to receive mental health treatment, the right to refuse psychiatric treatment, coercion to mental health treatment, and civil commitment and treatment of sex offenders.

Competency to Stand Trial (CST)
Title and Citation: Jackson v. Indiana, 406 U.S. 715, 92 S.Ct. 1845 (1972)
Type of Action: Violation of Fourteenth Amendment rights due to committing an incompetent
petitioner to a mental hospital
Facts of the Case: Theon Jackson, the petitioner, is mentally defective cannot read or write
neither communicates only by use of limited sign language. Jackson at the age of 27 that is in
May 1968 was charged in the Criminal Court of Marion County, Indiana with different cases of
theft from two women. The first instance entailed the woman’s belongings, a purse, and contents
worth four dollars. The second instance concerned stolen money, five dollars. On both accounts
Jackson pleaded not guilty, this led to the Indiana court requesting for Jackson to be tested on
competency to stand trial. Competency analysis and evidence from psychologists showed that
the intelligence level of Jackson is too low for him to understand the accusations against him.
Even with the ability to communicate or hear, Jackson would still not understand the charges.
The petitioner, Jackson, could neither learn to write or read or improve mastery in sign language.
The state of Indiana testified that they had no facilities to treat Jackson mentality problem
however he was still confined in a psychiatric hospital.
Contentions of the parties: Jackson counsel filed an appeal. The petitioning party argued that
there was no substantial evidence that Jackson was insane or he would come to the state that the
court refers to as sane as defined by competency to stand trial. Further, they contended that
committing Jackson under this situation is equal to a life sentence and he has not even been
convicted of committing a crime. By this, Jackson has been denied his right stated in the
Fourteenth amendment the rights to equal protection and due process and as mentioned in the
eighth amendment, subjected to cruel and unusual punishment.
Issue: In the case, the Appellant is found incompetent to stand trial, should the courts confine the
person for a reasonable amount of time to determine whether he will attain the ability in future?
And what if the person cannot regain the capacity?
Decision: The Supreme Court ruled that Indiana cannot commit a petitioner for an indefinite
period on the basis that his incapacity to stand trial on charges against him if he could not be
convicted. The lower courts committed Jackson to a mental Health unit until he can satisfy the
court of sanity. The forensic psychologist has the duty to carry out further audits and determine
the mental state of a defendant thus allow for further examination and admissible. The above
arguments put forth that experts in the field are in opposition to assist prosecution put out a
formidable case that can allow the cases to allow for investigations and proper conduct.

Reasoning: The lower court arrived at a decision basing on facts that Jackson lacked sufficient
comprehension to prepare his defense. The court also based on the results provided by the
doctors who tested Jackson that affirmed his incapacity to withstand a trial. The Supreme Court
