Global there are limited alternatives subject to incarceration as judges sentence a
criminal. Since most of the prisons and jails are exceedingly overcrowded, the offenders may be
given house probation or arrest instead of being sent to prison. In other instances, the offenders
may serve a part of their sentence in prison and later be given parole. The judge decision highly
depends on the nature of the crime.
Following Mr. MacMahon’s violation of the terms of his probation, the most befitting course of
action would be that he be summoned to court and the question of whether he should serve his
sentence in prison, be re-examined.
In a bid to rehabilitate, probation has proven effective for many offenders but in some cases, as
the one presented by Mr. McMahon, it has proved ineffective and in some instances has resulted in
recidivism. I suggest that probation may not be the most ideal way of rehabilitating the offender in
question. It is the responsibility of the party involved, in this case, Mr. McMahon, to strictly adhere to
the terms of probation as stated in the presiding judge’s ruling. Mr. Mc Mahon violated these terms and
therefore he should be made to appear before court and furthermore I would like to suggest that
perhaps it would be best if his probation was revoked.
