Alternative sentences are methods of sentencing that do not necessarily involve the
convicted person going to jail. Light jail sentences can be coupled with a number of alternative
sentences which may include fines, probation, restitution, community service, suspended
sentences and pretrial diversions. The aforementioned alternative sentences are in most cases
given to first time offenders based on the defendant’s remorse, age, criminal history, crime
severity and the effect of the crime on the victim.
This paper focuses on the case Brock Turner case where the defendant was charged with
five counts all pertaining to the rape of an intoxicated and unconscious victim. At the end of the
trial, the defendant was given a six month jail sentence together with probation and an order to
register as a sex offender. The alternative sentences in this case are the probation sentence which
falls under probation and the order to register as a known sex offender.
Probation is the release of a defendant back into the community but with strict conditions,
rules and restrictions that are followed up by a probation officer. Probation can take place even
