Introduction
Drug regulations and the enforcement laws involve controlled substances that are
generally forbidden. Controlled substances that those that are usually diverted from their
intended medical use. The federal government prohibits the production, distribution, as well as
possession of many of these intoxicating substances, which are only intended for recreational
purposes. Nevertheless, the federal government also permits and controls the medical use of
some of these substances. In a move to restrict and lower the availability of illicit drugs, the
government focuses on drug enforcement, making them more difficult, expensive and even
riskier to obtain.
The History of Drug Regulation and Controlled Substance Laws
In the late 19th century to the periods in the early century, the recreational, as well as the
medical use of drugs, did not face any restriction and regulations from the government regarding
their distribution and use, and there were no agencies for regulating the associated medical and
pharmaceutical practices. However, in response to the escalating rates of drug abuse in this
period, the government, resorted to taxation to control and regulate drugs, giving rise to the
Harrison Narcotics Act, 1914, which required the registration of the stakeholders of opium and
cocaine with the U.S Treasury. The 1937 Marijuana Tax Act was established by the Federal
Bureau of Narcotics to deal with the rising cases of marijuana abuse. The mid -20th century saw
the Congress introducing drug control legislation and criminalized drug abuse. Prison sentences
were established for certain drug offenses and selling drugs like heroin to the young persons
would lead to a death penalty. The Presidential Commission in 1963 transferred the drug
