Restorative Justice
Restorative justice mainly aims to rehabilitate offenders through reconciliatory means
and ensuring that the offenders understand the harm they cause and refrain from such offenses.
Victim-offender mediation, conferences, peacemaking circles, and victim-offender panels are
some of the dominant means of indigenous restorative justice in different parts of the world.
While they all present advantages and limitations, they have shown great applicability in the
modern world by acting as a complementary justice system to the conventional systems. By
understanding their application and efficiency in restorative justice, it is possible to understand
the place of these indigenous means of justice in the modern society.
One of the most common techniques used in the current justice system is the victimoffender mediation. This mediation normally involves direct conversations between the offender
and victim with the presence of a mediator. According to CRJP284 (2009), the biggest advantage
of this method is that it fosters one on one dialogue between the offender and the victim.
Therefore, the mediator’s role is limited to guiding the two parties into agreeing. The
conversation typically involves the discussion of each party’s feelings, explaining to each other
how the offense might have affected them, and restitution terms. Bright reported that the method
