Confidentiality is a critical topic in the mental health profession.
All professionals in the mental health professionals have both a legal and ethical obligation to
observe confidentiality.
Legally, all professionals have the duty of confidentiality that entails protecting clients’ health
information and data from unauthorized access or release. Additionally, mental health
professionals also have an ethical obligation of observing clients’ confidentiality because
confidentiality is vital in building client’s trust.
Further, the breach of confidentiality has profound impacts on the client, the mental health
profession, as well as the society at large (American Counseling Association, 2005).
Breach of confidentiality affects clients’ private lives and their ability to relate with others in
the society. Further, there are various laws that protect clients’ confidentiality such as the
HIPAA (US Department of Health and Human Services, 2003).
Breach of confidentiality is regarded a violation of these laws and results in legal repercussion
such as suspension of the professional, suspension of professional’s license, as well monetary
compensations or jail terms.
Violation of confidentiality also affects the entire department that can be held liable for the
actions of the various staff members under the department.
Further, observing clients’ confidentiality involves understanding when to break it and reveal
private information in such cases as cases of child abuse.
As a result, it is critical to understand clients’ confidentiality and protect it at all times.
