CJST 1105-01 Rev. 01/14/18 1 Situation Sam, a sales representative, has been with your company for one year. This is his fourth job in three years. Coworkers have indicated that he is unhappy in his current role and feels under-appreciated. Coworkers have also expressed concerns related to potential personal problems at home and substance abuse. The company Sam works for has minimal training related to ethics and the overall company posture is lax related to policy enforcement and violation reporting. Sam is allotted an expense account that allows for reasonable entertainment expenses related to business development. Entertainment expenses cannot exceed $1,000 per entertained person annually. In addition, company policy outlines that employee daily business meal expenses cannot exceed $75 daily. The company pays expense accounts each month without auditing them. External auditors select a few sales representatives each year for expense account audits. The sales representatives know this because any errors located in this random audit are reported to them and the error (plus or minus) corrected. Sam knows he could keep the proceeds for over-inflated expense reimbursements if his expense account were not chosen for the audit that year. If caught in an audit, he knows it would simply be attributed to an error in addition on his part. At year-end, Sam’s account was chosen for audit and it was identified that Sam exceeded the annual entertainment expense limits for several people this past year. Also, when speaking with a few of the people reportedly entertained, they denied meeting with Sam. Questions 1. Identify any concerns pre-employment and what measures may have resulted in a different hiring decision? 2. Identify any concerns after hire and what measures may have resulted in prevention or earlier detection? 3. What leg(s) of the Fraud Triangle were evident in this situation? 4. What steps would you take to investigate this matter? CJST 1105-01 Rev. 01/14/18 2
