Introduction

The death penalty is the most serious form of punishment that involves execution of the offender
in criminal cases. It remains the most controversial and criticized form of punishment all over the world
especially by human rights movements such as the human rights watch and the United Nations
Commission on Human Rights. Public opinion indicate that majority of individuals worldwide are
against it although remains to be practiced and misused for political mileage especially in Asia and
Middle East countries (Hoyle and Hood, 2015). The penalty is majorly served for offenders of terrorism,
drug trafficking, murder, robbery and rape. Arguably, in the United States, some people argue that the
capital punishment penalty is mainly biased towards blacks depicting a case of racism in the justice
system. This study seeks to determine whether there is significant statistical evidence showing that the
justice system serves the death penalty mainly to blacks while the whites enjoy less punitive
punishments.

The purpose of this research is to determine whether racism exists in the judicial system. It is
important that the justice system is fair to all so that no individual is served unfairly as a result of his
race, religion, or nationality (Hood, Roger &Carolyn Hoyle, 2015). Races in society should celebrated
and embraced since it brings about diversity and no individual should be a victim of his race. The
research would also make the scholar community aware of the associations between races and criminal
punishments. Government agencies and human rights organizations would also benefit from the results
