For your initial post this week imagine that you are a lawyer arguing a case concerning federalism before the Supreme Court of the United States of America. This case has to do whether the power to create policy on a particular issue should be in the hands of the Federal Government, left to the States, or left in the hands of individual citizens.

Then, you must support your argument to the Supreme Court by finding and using an applicable part of the United States Constitution.

Respond to the two following statements:

1. May it please the court, the federal government, not the states, has the power to pass education policy because … the federal government has more resources than the states to fund education. We need an Amendment that will give the federal government this power because education is not written in the Constitution and falls under the 10th Amendment. Under this amendment, states carry any power that does not fall under the Constitution or is not forbidden by the state.

When education is decided at a state level there is no standard education requirements for our youth or us as Americans. We have 52 states that all have their own education requirements and funding. Yet, education depends on how good the school system is.

The federal government could implement an “American Education Curriculum Act” and each state would be required to teach from that curriculum. This would ensure that all Americans are receiving the same education.

Oh Yeah, this would also get rid of any private or home school programs. The federal government will be able to provide quality education that any parent could afford.


2. May it please the court, the states, not the federal government, has the power to legalize marijuana because this will cut down on the drug busts in the cities and so many people trying to buy and use illegally. This will bring revenue back into the states even without the federal government passing the bill. This will allow for states to be able to have funds for special projects that need to be done in their communities. Passing this bill will allow people will medical conditions to be able to get this drug with no problem to help control their symptoms. We shall really consider passing this bill it will be best for the states.
