Introduction
The advent of social media makes it difficult for the school administrators to maintain the
safety of the students, especially following the Columbine and other shootings in schools,
without infringing into the students' free speech rights as per the constitution. However, although
the Supreme Court of the United States has not yet been clear on the use of the social media
posts by the students off the school, courts have increasingly demonstrated that schools have the
right to punish students for particular social media postings. It is apparent that students do not
lose their constitutional rights in or out of the schools. Nonetheless, free speech rights are
somewhat restricted in schools than in any other places. In a landmark case of Tinker v. Des
Moines Independent Community School District, the court determined that schools might limit
free speech that violates the rights of other students or if the speech extremely disrupts the
running of the school programs (Dagley & Weiler, 2017). This paper discusses the situations
where the schools may punish a student for a social media post. In this regard, this paper cites a
Lawsuit that explicates the need to punish a student for a social media post. In addition, this
paper presents a policy that relates to social media postings by the students and the rightful
actions by the school administrators.
