Introduction

Mark is the defendant who was accused and charged with driving while intoxicated
(DWI). This was after the car that Mark was driving got into an accident and his friends were
injured and one died. George, the owner of the car, is taken to the Trauma Centre with the lifethreatening case. The accident was due to drinking and driving where Mark drove under the
influence of alcohol. After a toxicology test, Mark had a level of 0.21 blood alcohol level. The
car had more passengers than expected and thus the seat belts could not fit all the passengers in
the car. This is why one of the friends was overthrown outside the car. This paper will examine
different points of the process of the criminal justice, the possible steps involved, the steps in a
state with the Grand Jury system who will listen to the case and the evidence presented. After the
accident, Mark talked to the Highway Patrol Officer since he was sober enough to give his side
of the story. After the sobriety test where he failed, he was later arrested. Further investigations
were needed and thus a reconstruction team was required to determine other factors that led to
