Legalization of Marijuana Paul,Sandino,Marvin,Kledis,Jeff,Phoebe Facts Prohibition began 80 years ago Controlled Substances Act of 1970, Nixon, Schedule I Substance Marijuana is classified as a schedule 1 drug which simply means there has been no study to confirms any medical use and potential for abuse. California Passes Compassionate Use Act of 1996 Decriminalization vs Legalization Decriminalization - in case of the accuse been found with possession of weed in a decriminalized state then the charges against the individual immediately result in the individual incarceration but payment of a fine which is a less severe consequence. Legalization - allow to legally have a certain quantity of marijuana to be carried by an individual. ● ● Medicinal legalization - requires prescription for legal use of the substance. Recreation - does not require prescription for the use of marijuana. Statistical Graph Pros: Marijuana is no more harmful to a person's health than alcohol or tobacco. Claims that weed helps with: pain, nausea and loss of appetite, Parkinson’s disease, inflammatory bowel disease, PTSD (post-traumatic stress disorder), epilepsy, and multiple sclerosis but no extensive research has been conducted. Cons: Potential Side effects: respiratory problems if smoked, schizophrenia and psychosis, car crashes, general social achievement in life, and potentially babies in the womb. View as a “gateway drug” that will eventually lead to harsher drug consumption.(Potential addiction.) Creates Jobs in the cannabis cultivation Frequent marijuana use can seriously affect your short-term memory. Save Money in the war against drug for the taxpayers. Smoked marijuana contains cancer-causing compounds. Promote consumer safety using informed decision and background on the product they are purchasing. Utilitarian Approach ● A utilitarianism perspective on marijuana would be for the greater good. ● Utilitarianism argues that, given a set of choices, the act we should choose is that which produces the best results for the greatest number affected by that choice. That choice should be for the medicinal value of marijuana, to help the people in pain to not be in pain. ● The perspective of utilitarianism on the legalization of marijuana for personal use and medicinal use is based mostly on the greater good for the people who suffer from a painful ailment. Utility Recreational: ● Tax revenue ● Regulated thus preventing widespread and abuse Medical: ● Less costly than alternative ● More effective than alternatives Rights Theory A right is an entitlement, so if you have a right to something then you are entitled to that thing. The legalization of marijuana is further justified by the rights approach to ethics. The government has no right dictating what can or cannot be put in one’s own body. In other words, society is bound by the negative right, that being “a claim by one person that imposes a negative duty on all others” Is it ethical to deny a person their right to life, liberty, and the pursuit of happiness. Marijuana, a plant, is the path for many to their pursuit of happiness away from pain, how can they be denied. Types Of Rights Negative rights: ● Recreational: ○ Property: right to do what they please with their body ○ Liberty: pursue the things that make them happy, for example being high Positive rights: ● Medical ○ Well being: if marijuana can help with a particular medical condition the patient should be allowed to utilize it. ○ Social Contract: for medicinal purposes marijuana is legal in most states. ❖ Theorist- Kant views Marijuana use, in moderation, doesn’t violate Kant’s moral maxim: a world where everyone smokes once in a while wouldn’t be much different that the world we live in. Kant would object to the push for legalization of marijuana arguing that just like other drugs, marijuana violates an individual’s duty to respect their rational nature. Kant continues to state that if a person destroys his body in an effort to escape from a difficult life situation, the person is merely using his "person" as a means. Kant is clear about the autonomy of the user. Marijuana is usually abused leading to addiction, cognitive damage or even short-term memory loss. In this case, marijuana infringes on the user's freedom. The decisions that such a person makes are not devoid of the consequences of his or her state. Therefore, a marijuana addict cannot act or reason in autonomy. Kant’s Views Recreational 1. Is this the right thing to be done? ● Kant would consider getting intoxicated the motive based on emotion therefore not a good motive 2. Can this law be universalized? ● yes, because as most of the polls indicates people are willing to accept this as norm. 3. Are we allowing ourselves or treating others with respect or simple as a mean? ● We will be treating ourselves as a mere means for personal satisfaction. Medical 1. Is this the right thing to be done? ● Yes, only if the use of the substance is for medical purposes. 2. Can this law be universalized? ● Everyone seems to be on-board with medical use of marijuana. 3. Are we allowing ourselves or treating others with respect or simple as a mean? ● We are treating ourselves with respect because may be medical condition originated from something that the we couldn't control. Legalization allows to a certain legal extent where a quantity of marijuana should be
allowed to an individual. Marijuana can be taken either for medical purposes or for the recreation
point of view. The Controlled Substance Act argue against the legalization of the medical
marijuana and it's believed to be as a scheduled and one drug. According to the Act, marijuana is
defined as a very harmful, addictive and result in usage of more harmful drugs. It's also believed
by the group that, legalization may result to a notion that, the recreational use of marijuana by a
certain group of people result to the recreational point of view and will be deemed as morally
acceptable and might be believed as important to the body. The legal argument on arguing
morality and immorality of marijuana is the Controlled Substance use ("Title 21 United States
Code (USC) Controlled Substances Act - Section 801-971", 2016).
The majority of the people that regard supports the legalization marijuana base their
arguments from the California compassionate use Act of the year 1996. It’s believed that medical
marijuana is important and appropriate in therapy use in the treatment of severe illness that has
been found ineffective and resulted in severe side effects. This type of argument is against that,
the public or the population, in general, will be prone to engage in illicit use of drugs if the
medical marijuana is legalized to all the palliative therapy for patients. This stance is also against
the fact that marijuana is the main drug leading to usage of harder drugs ("What you can expect
from medical marijuana", 2015).
After a thorough research on the article on both the impacts of legalization and not
legalizing the marijuana, in my opinion, I disagree with the legalization of marijuana as a moral
but the act is immoral. This is because scientific research can be done properly without
legalization. There has been a lot ...
