Antitrust Law 450 words

Review the “AT&T Pulls $39 Billion T-Mobile Bid on Regulatory Opposition (Links to an external site.)Links to an external site." article.

In 2011, AT&T attempted a merger with T-Mobile. The Justice Department sued under the act, claiming that the merger would constitute a violation of the antitrust laws. In 2012, AT&T dropped its attempt at the acquisition.

If AT&T had merged with T-Mobile, would the merger have violated antitrust laws? Why, or why not? Do not be unduly influenced by the Justice Department’s stance on the issue. Use your own analysis to reach a conclusion.

Merger between AT&T and the T-Mobile

AT&T which is considered as the second largest provider of the wireless service
provider in the whole US in 2011, reported being in a great need to merge with T-Mobile. TMobile is ranked fourth in the same business in the US. With this merger deal, a great
improvement could have been evident. It could have added T-Mobile up to 33.7 million
customers while AT&T could have accrued to itself an approximate of 100.7 million
subscribers to their venture. With this, they could have gone way above Verizon Wireless
which at this moment, stood at an approximate of 107.7 million subscribers (Moritz,
Cornelius & Elstrom, 2011). With these increments, they could have developed a competitive
advantage on their business and extended their lead in the US market. The elimination of one
of their competitors, i.e., AT&T eliminating T-Mobile could have been viewed as a violation
of the antitrust rules which discourages mergers, amalgamations and acquisitions of direct
competitors especially when anticipation of monopoly to occur. This will affect the
stabilization of prices.
