Every criminal suspect has the right to a jury trial and the right to defend themselves against criminal charges. Once a criminal suspect has been charged with a crime and arraigned a court date will be set. The prosecutor and defense attorney will then begin to pick a jury from a pool of people selected from the community. The prosecutor must prove the criminal defendants guilt beyond a reasonable doubt and the jury will determine the innocence or guilt of a criminal defendant. The role of the jury is to hear and weigh evidence that is presented by the prosecutor and defense attorney in order to make a determination of guilt or innocence. In a jury trial, the jury is selected by the parties through a process called voir dire, where the judge or parties ask jurors questions in order to determine their biases and opinions (Churchill, 2009). The prosecutor and defense attorney are looking for jurors that will provide a fair and unbiased determination of guilt or innocence. This right was established in English common law and became a fundamental part of the Constitution. Juries cannot have preconceived ideas about the case or personal bias concerning the events revolving around the crime. In order for a criminal defendant to get a fair trial the jurors must have little or no knowledge of the crime
