A 12-year-old boy was caught in the act of sexually assaulting a 14-year-old female acquaintance by the victim's 16-year-old brother, who had arrived home and observed the juveniles in the act. The 12-year-old juvenile suspect, in addition to sexually assaulting the victim, had beaten her with the heel of a shoe that was nearby. The victim was almost unconscious when the police arrived. The girl; however, had been beaten severely using heal of a shoe and was almost in a state of unconscious when police arrived. The juvenile was charged with attempted sexual assault, aggravated assault, minor in possession of an alcoholic beverage, and unlawful possession of a controlled substance. In this case the controlled substance was marijuana. The juvenile claims the sexual act that was interrupted by the brother was consensual and that the alcohol and marijuana were purchased by the victim. The juvenile had prior detentions for violation of curfew, truancy, and attempted sexual battery.Perspective of the Police Officer When dealing with juvenile delinquents the police officer has great latitude and can apply discretion. In the case were a juvenile offender has been accused of a violent and heinous crime the law enforcement officer would immediately detain the juvenile and transfer them to juvenile probation or intake officer.
