There are different crime models that are disputed in being more effective such as the crime control model and the due process model. Within criminal law there are certain limitations charging and convicting anyone. In the process of determining a persons' guilt, justifications and excuses can be made as to the reasoning of why a certain crime was committed. The Bill of Rights was formed to protect the accused from unlawful treatment and convictions. There is also the Due Process clause that protects every individual's, "life, liberty, and property". The evolution of the criminal justice system has vastly progressed into a system that recognizes "gray areas". These safeguards have been put in place to accommodate people who have cases that do not fall into any certain category. By altering the Constitution with these safeguards it becomes clear that the people still have an exceptional amount of consideration in the way that the justice system works and continue to maintain the rights of the people as a democracy.
