In this ruling the high court determined that women have the right to have an abortion in the early part of her pregnancy. The specific language in this high court ruling that has contributed to the debate is "the unborn child is not a person" so they are not afforded due process rights (Gargaro, 2000). The court found the Fourteenth amendment protects the woman's right to have a choice over whether or not to have an abortion or it would deny the woman liberty. Women have a right to personal privacy even if that includes terminating an unwanted pregnancy. In the Planned Parenthood of Southern PA v. Casey ruling the court determined the state did have the right to make specific requirements that would be paired with Roe with the exception of the requirement that the woman must first inform her spouse before having an abortion (Devins, 2009).
