The government was established in a way that was designed to ensure that one branch of the government never has total control over the government. Even though the goal of the writers of the Constitution to ensure equality in the power provided to these three distinct branches over time the balance has shifted. In addition to the broad separation of powers into three branches, the Constitution keeps the legislative and judicial branches separate with various specific provisions (2005). The executive branch is made up of the president who has the power to veto any legislation enacted by Congress or the legislative branch while the judicial branch has the power to determine if a law created by the legislation is constitutional.
