The state has the authority to implement drug legislation but when the federal government implements a drug policy the state is required to develop a similar piece of legislation in their state. In some cases, such as the Violent Crime control Act, the state will receive additional funding if they comply with the new drug legislation. When the federal government creates new legislation each branch of the government will play a specific role in the process. Drug legislation involves the development of new sentencing policies or to control the use possession of these drugs. Drugs are controlled substances that have been determined by the federal government to be illegal and illicit. Drug laws consist of simple possession cases to the trafficking of large quantities of drugs. These laws prohibit the use, possession, or sale of drugs deemed illicit through legislation. Just like any other policy, legislation starts with an idea. Drug legislation began when drugs began to become a problem in society and some person or social group decided a law was needed to address this problem.
