1. What are the differences between adversarial and inquisitorial systems of law? Is the U.S. system an adversarial or inquisitorial system? Provide a specific example of a case involving an adversarial system and one involving an inquisitorial systemThe inquisitorial system is different than the adversarial system because the process is more focused on the judge who is allowed to question witnesses, develop evidence, and is fully engaged in the litigation process. In the adversarial process there are two opposing parties that introduce evidence to a judge or a jury. The prosecutor introduces evidence of the criminal defendant's guilt while the defense introduces evidence of the defendant's innocence. America has an adversarial court process where two opposing fight to have their opinion heard and believed by the jury or the judge. After closing arguments the judge or jury, depending if a jury or bench trial, will take all of the evidence that has been introduced and make a determination of guilt or innocence. In the inquisitorial process the judge gather relevant evidence and the defense attorney has very little say over the matter. Once the judge has gathered all of the relevant data they will review the case and make a determination. In most cases the ruling will come by mail as well as the sentence that will be received.
