In this paper I will identify the certain aspects of criminal law. I will describe the purpose of criminal law, the two main functions of criminal law, and written sources of criminal law and their purpose. I will also discuss how criminal law can be limited, identify one justification and excuse difference, and why it is used. This paper will also show the procedural safe guards that protect American constitutional rights; which will include the bill of rights and due process.The Purpose of Criminal LawCriminal laws purpose is to serve and to protect the public from criminal harm. There are two basic functions of the criminal law system. The first is the legal functions of the law. These are laws that the public decides are right or wrong for a particular community and those that protect the public from criminal harm. Harms can be categorized into two groups. These two groups are harms to individual's physical safety and well-being, and harms that affect society's interest collectively. The second, function of criminal law is to maintain and promote social values; such as are those that are against prostitution and gambling.
