BaltimoreFacts: John Barron was co-owner of a profitable wharf in the harbor of Baltimore. As the city developed and expanded, large amounts of sand accumulated in theharbor, depriving Barron of the deep waters which had been the key to hissuccessful business. He sued the city to recover a portion of his financial losses.Question: Does the Fifth Amendment deny the states as well as the nationalgovernment the right to take private property for public use without justlycompensating the property's owner? Conclusion: No. The Court announced its decision in this case without even hearingthe arguments of the City of Baltimore. Writing for the unanimous Court, ChiefJustice Marshall found that the limitations on government articulated in the FifthAmendment were specifically intended to limit the powers of the nationalgovernment. Citing the intent of the framers and the development of the Bill ofRights as an exclusive check on the government in Washington D.C., Marshallargued that the Supreme Court had no jurisdiction in this case since the FifthAmendment was not applicable to the states.Crt told him this is a state or local ordinance, therfore u cant look to the nationalgov. to protect ur rights, ur recourse is w/in the states that was before we hitthe civil warthe aftermath of war is the Reconstruction era 1965-77 the nationalgov, was under the control of the radical republicans ( absolutely 100% committedto reworking the structure of system) civil
