Federal Tort PaperName AJS562DateProfessorFederal Tort Paper The Federal Tort Claims Act of 1946 is a law created to ensure if people in society become harmed by a federal worker they will be properly compensated or if they wanted to sue the federal government they would have the vehicle in which to do just that. The Federal Tort Claims Act of 1946 provides citizens with a way around the immunity placed on federal employees. Before Congress enacted the Federal Tort Claims Act of 1946 citizens had no way of suing the government for perceived wrongs. Instead the federal employee was immune to be sued no matter the harm they caused the victim. The Federal Tort Claims Act of 1946 provided citizens with a remedy to sue the federal government but it also took the power to regulated federal lawsuits claims and gave it to the courts. Despite the fact that the First Amendment gave the citizen the right to address any grievance with the government there was no actual mechanism allowing this to occur. For hundreds of years critics found not providing a vehicle to sue the government was unconstitutional but it was not until the 20th century that this problem was addressed through legislation. In 1855 congress enacted the Court of Claims Act which would allow citizens to complain but excluded torts or any true civil liability.
