This legal system benefits every citizen of the United States by affording them the right to due process. The criminal justice system also incurs issue and challenges. One of the greatest challenges facing citizens in American society is terrorism. This is not a new problem but has become a major threat to American society. Another modern challenge facing the criminal justice system is cybercrimes. Cyber crimes develop as quickly as new technology evolves. A past, present, and future challenge of the criminal justice system is the issue with overcrowding. History of the American Criminal Justice System The criminal justice system developed out of the common law practice of the English government. The English government established a basic structure of justice that included retribution, provides sanctions against offenders, restores the victim, directs behavior, right to own property, and guilt must be proven beyond a reasonable doubt (7). Many, if not all of these sanctions are found in the criminal justice system. The societal and cultural differences of the colonists changed many facets of the English Common Law. The foundations of both systems were based on the laws of God. In order to create law and order and liberty for American citizens a new and improved system was developed.
