When the federal government is liable for a negligent or wrongful act against a federal employee the employee has the right to sue the federal government. The act developed in 1946 when Congress acknowledged there are some cases where the federal government does not have sovereign immunity. Sovereign immunity refers to a common law right of the federal government that says the government cannot sue themselves. Since Congress is the only entity capable of waiving the sovereign immunity, it was rare that the government ever waived this immunity until the development of the Federal Torts Claim Act. According to the Federal Torts Claim Act the federal government is liable in some cases and can be sued. The federal government is now liable when a citizen is wronged by a federal employee. This can be difficult to understand and results in millions of potential claims where a citizen can sue the federal government. If a citizen was driving down the road and got into an accident with a military truck, if the federal employee was negligent the citizen has the right to sue the federal government.
